Social Security Law

What are SSI and Social Security Disability?

Social Security administers two programs, which pay disabled people.  One of the programs is Supplemental Security Income (SSI); the other is “regular” Social Security, or SSDI.
The SSI program is an entitlement program paid to people who have no work record or have not worked during the past five years.  There is an asset limitation and a household income limitation for eligibility as well.  There is immediate medical coverage with this program.

The SSDI or “regular” disability program pays a claimant based on the money paid into Social Security during his or her work life.  The amount is determined by how much has been paid in, divided by years of life expectancy.  Payments may also be sent to a spouse and children.  There is s 24-month wait for Medicare coverage eligibility under this program.

If you have ever dealt with Social Security, then I am sure it comes as no surprise to know that over 60% of claims are routinely denied at the initial level.  Many people do not appeal because they are worn down by the system and become discouraged.

Having an expert law team on your side to fight for your claim to be reopened could ultimately mean having access to more years of back benefits.

Let Us Help you get the benefits you deserve!
Arehart & Ernzen can make sure that the necessary appeals are filed within 60 days from the denial.  We monitor every stage of the claim to be sure you get the benefits you deserve.

Fees
All fees in Social Security and SSI disability cases are set by Congress and must be approved by the Social Security Administration as part of the process when a case is won.  Fees are 25% of any back benefit you receive, with a current maximum fee cap of $5300.

No fee is paid unless and until you win your case!
